On
June 4, 1998, a Sarasota Circuit Court judge ruled that speed
humps and speed tables were traffic control devices. The judge
determined that these devices were not mentioned in the Manual
of Uniform Traffic Control Devices (MUTCD), to which the City
of Sarasota must adhere, and were therefore unlawful.

On
June 23, 1999, the City prevailed in the District Court of Appeal
of Florida. The court did not rule on the issue of whether or
not speed humps and tables are traffic control devices. Judge
Casanueva ruled on the issue of standing, i.e. and determined
that the plaintiffs had no legal right (or standing) to bring
forth such a lawsuIT . The Appellate Court ruled that the only
body that has jurisdiction over the right to fully define speed
humps and tables is the Florida State Department of Transportation
(FDOT). FDOT has included speed humps and tables in its 1999
draft edition of the "Greenbook" and stipulates that
these traffic calming techniques are not traffic control devices.
